SMS messaging terms and compliance
Program description. This messaging program sends service and appointment messages to people who have booked a call with KOVO through this website or its scheduling forms and have explicitly opted in to receive SMS. Opt-in is collected through web forms with a dedicated SMS consent checkbox. Messages include booking confirmations, call and appointment reminders, rescheduling updates, project updates, and customer support communications. Consent to receive messages is never a condition of purchasing any product or service.
Cancellation. You can cancel the SMS service at any time by texting STOP to the number that sent you messages. We will confirm your unsubscribe by SMS, after which no further messages will be sent. To rejoin, opt in again the same way you did originally.
Support. Reply HELP for assistance, or email info@kovodesign.com during business hours.
Carrier liability. Carriers are not liable for delayed or undelivered messages.
Message and data rates. Message and data rates may apply to messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text or data plan, contact your wireless provider.
Supported carriers. The program works with all major U.S. and Canadian wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, Rogers, Bell, Telus, and most regional carriers.
Age restriction. You must be 18 years or older to participate in the SMS program.
Privacy. Handling of mobile numbers and consent records is described in the Privacy Policy. Text messaging opt-in data and consent are never shared with third parties or affiliates for marketing purposes.
KOVO complies with all applicable laws and guidelines governing SMS communications, including the Telephone Consumer Protection Act (TCPA), CASL, and CTIA messaging principles.

Project agreements
Scope, deliverables, timing, fees, payment schedule, revisions, support, cancellation, intellectual property, and all other project terms are defined in the written proposal, subscription terms, or services agreement accepted for that engagement. If website content conflicts with a signed agreement, the signed agreement controls.
Managed monthly plans
Unless a separate written agreement states otherwise, KOVO owns the final website source code created under a managed monthly subscription. The client receives the right to use the live website while the subscription remains active and paid. A plan may be cancelled, but the website will be taken offline at the end of the paid billing period. Domain arrangements, included services, and any transfer rights are governed by the selected plan and the written agreement.
Custom projects and scope changes
Ownership and licensing for custom projects are stated in the applicable agreement. Requests outside the agreed scope may require additional fees and may affect timing. KOVO will communicate material changes before undertaking added work.
Intellectual property
The website’s design, text, graphics, code, branding, and other content are the property of KOVO or its licensors and are protected by copyright, trademark, and other laws. The website is provided for your personal, non-commercial reference. You may not modify, copy, reproduce, republish, upload, transmit, translate, sell, create derivative works from, or otherwise exploit website material without written permission, although you may download or print individual pages for your own non-commercial use provided all proprietary notices remain intact. Third-party marks and content remain the property of their respective owners.
Material you submit

Links do not imply endorsement, and KOVO is not responsible for third-party content, products, services, or availability. Dealings between you and any third-party provider are solely between you and that provider. Termination of website access does not by itself terminate a signed project agreement, which is governed by its own terms.
Limitation of liability
To the extent permitted by applicable law, KOVO is not liable for indirect, incidental, special, or consequential losses, including loss of profit, revenue, or data, arising solely from use of this informational website. Liability relating to paid services is governed by the limitation stated in the applicable client agreement. Nothing in these terms excludes liability that cannot lawfully be excluded.
Governing law and disputes
These Terms of Website Use are governed by and construed in accordance with the laws of the jurisdiction in which KOVO Design Agency operates, being the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Any dispute arising under these terms shall be resolved exclusively through binding arbitration in that jurisdiction, unless a signed client agreement specifies a different forum or dispute-resolution process, in which case that agreement controls. Nothing in this section removes a right to bring a claim that cannot lawfully be subject to arbitration.
Changes to these terms
KOVO may revise these terms or impose new conditions on use of the website from time to time. The revised version is posted on this page with its effective date, and continued use of the website after posting constitutes acceptance of the modified terms.
